1. In General
Kenexx, Inc. (“Kenexx,” “we” or “us”) values our customers and respects their privacy. This privacy policy (“Privacy Policy”) governs our collection and use of data in connection with our website (the “Site”), our mobile applications (the “App”), and any services we offer (collectively, the “Services”). Terms capitalized but not defined in this Privacy Policy have the meaning given to them in our Terms of Use.
This Privacy Policy sets forth the nature, purpose, use and sharing of any information that identifies or can be used to identify you, the visitors to the Site, and users of our Services (“Personal Information”). This Privacy Policy does not govern privacy practices associated with offline activities, websites other than ours, or practices of third parties that we do not own or control, such as our partners, third-party service providers featured on the Site or in the Services, or advertisers. If you have objections to the Privacy Policy, you should immediately discontinue use of the Services and follow the procedure described in the section entitled “Opting Out or Updating Your Personal Information and Privacy Preferences.”
The Site and the Services are intended for adult audiences only, and we do not knowingly collect any Personal Information from anyone under 13 years of age. If you are under age 13, please do not provide any Personal Information about yourself to us. If we learn that we have collected Personal Information from a child under age 13, we will delete that information as quickly as possible. If you believe that we might have any Personal Information from a child under the age of 13, please contact us immediately.
2. Changes in Privacy Policy
Any Personal Information that we collect and maintain will be subject to this Privacy Policy, as amended from time to time. We may change the Privacy Policy at our sole discretion. However, if at any time we make material changes to the Privacy Policy, we will notify you of those changes on the Site and through the publishing of an updated Privacy Policy. If as the result of such changes you want to alter the ways in which we are allowed to use your Personal Information, you can do so by following the procedure described in the section entitled “Opting Out or Updating Your Personal Information and Privacy Preferences.”
3. Collection of Information
- We collect the Personal Information you give us when you register with the Site or use the Services, including name, email address, phone number, postal or ZIP code, payout or bank information, and other Personal Information requested as part of your use of the Site or the Services, or the information you choose to give us when you use the Services.
- We automatically collect certain kinds of non-personal information from you when you use the Site or the Services, including device, browser type, operating system, referring or exit webpages, click patterns, Session ID, and your computer’s IP address.
- We may on occasion supplement or correct the Personal Information you submit to us and your IP address with information in our other databases or information from third-party sources in order to reduce errors in our database, authenticate our users, prevent fraud and prevent abuse of our Site, as well as to provide more consistent, relevant experiences to our users.
- We may collect general information about use of the Site and the Services, such as what pages visitors access, the number of visits, average time spent on the Site and other similar factors. This information is generally collected in aggregate form, without identifying any user individually, although IP addresses and Session ID in relation to downloads may be tracked as part of our fraud prevention efforts.
You agree not to submit any sensitive personally identifiable information to the Services.
4. Information From the App and Your Device
The App asks for certain device permissions. Each one is optional and can be changed at any time in your device settings; declining a permission limits only the feature that needs it.
- Contacts. If you choose to find friends from your contacts, the App sends the names, phone numbers and email addresses in your address book to our servers to match them against Kenexx members. We use this information only to show you which of your contacts are on Kenexx and to let you invite the others. You may send an invitation only to someone who has agreed to receive one from you. You can use every sharing feature without granting this permission.
- Camera and photos. Used to scan a QR code, to take or attach photos to a referral or a chat message, and to set a profile photo. Photos you attach are stored with the referral or message you send.
- Location. If you allow it, the App may record your approximate location when you share a Promotion, so a Merchant can see where its referrals come from. See “Location-Based Services” below.
- Notifications. With your permission we send push notifications about referrals, purchases, messages and your account. You can turn them off in your device settings at any time.
- Device identifiers. The App assigns a random installation identifier and records your device’s push token so we can attribute referrals to the right account and deliver notifications. These identifiers are not shared with advertisers.
5. Location-Based Services
Some Services may contain functionality that can enable us to access your location and tailor your experience based on your location (“Location-Based Services”). To use Location-Based Services, you must enable certain features of your mobile device (e.g., GPS, Wi-Fi, or Bluetooth) to allow us to identify your location. To the extent your location is collected through Wi-Fi or Bluetooth sensors, such sensors, and the associated data services, may be provided by a third party that may access such information for the purpose of providing such data services to us. You agree to such access by such third parties. You may enable or disable such Location-Based Services at any time via your device settings. If you choose to disable any Location-Based Services on your device, you will not be able to utilize certain features of the Services. By enabling Location-Based Services on your device, you agree and acknowledge that (i) device data we collect from you is directly relevant to your use of the Services, (ii) we may provide Location-Based Services related to and based on your then-current location, and (iii) we may use any such information collected in connection with the provision of Location-Based Services in providing the Services. PLEASE NOTE THAT LOCATION DATA MAY NOT ALWAYS BE ACCURATE, AND WE DISCLAIM ANY AND ALL WARRANTIES RELATED TO LOCATION-BASED SERVICES.
We may use your location to provide you with advertisements, offers, and other promotional content as part of the Services.
6. How Your Information Is Used
Except as provided herein, we collect and use your personal and non-personal information for internal purposes only or to gather aggregate and anonymized data. We may use your information in the following ways:
- To conduct routine business operations such as billing, paying Referral Bonuses, identification, authentication, contact purposes and general research. As part of our routine business operations, we may transfer your Personal Information to certain third parties with whom we contract for the limited purpose of providing services such as web hosting, email, and payment processing. These service providers are obligated to protect your information, and they do not use your Personal Information for their own commercial purposes.
- To attribute purchases to the Referrer who shared a Promotion, which requires sharing a referral identifier and the value of a purchase between us and the Merchant.
- To employ internal marketing techniques such as tracking customer preferences to provide a customized Site experience and communicating with you about Services, special offers, and other services.
- To enhance the Services.
- To gather generic product, location and other contributed information to make reports based on aggregate anonymized data, which we may use internally, or which we may sell to others.
- To comply with court and governmental orders.
7. Messages From Kenexx
Occasionally, Kenexx may need to contact you. Primarily, these messages are delivered by email or by push notification, and every account is required to keep a valid email address on file to receive messages. Kenexx may need to contact you by telephone to provide member support or for transaction-related purposes if you give us permission to call you. Additionally, and with your consent, Kenexx may send you an SMS (or similar) message or physical mail in order to provide you with customer support or to provide you with information about products and features that you may find of interest. You may update your contact preferences in your account settings.
Some messages from Kenexx are service-related and necessary for Referrers and Merchants. You agree that Kenexx can send you non-marketing emails or messages, such as those related to transactions, your account, security, or product changes. Examples of service-related messages include an email address confirmation or welcome email when you register your account, a password reset code, notification of an order, service availability, modification of key features or functions, and correspondence with Kenexx’s support team.
When you register for an account, or provide us with your email address or phone number or subscribe to a newsletter, you agree to receive marketing emails and messages from us. You can unsubscribe at any time from marketing emails through the opt-out link included in marketing emails or messages. Members may also control some marketing emails or messages through their account settings.
A contact-importer feature is available to help you locate and connect with your friends and contacts who may be members of Kenexx. If someone in your contact list is not already a member, you may invite them to join Kenexx and an email, SMS, or social media message will be sent to them on your behalf. You may send an invitation only to someone who has given you consent to receive one.
8. Tracking, Use of Cookies, Web Beacons and Similar Devices
In order to improve our Services and provide more convenient, relevant experiences to our customers, we and our agents may use “cookies,” “web beacons,” and similar devices to track your activities. A cookie is a small amount of data that is transferred to your browser by a web server and can only be read by the server that gave it to you. It functions as your identification card and enables us to record your passwords and preferences. It cannot be executed as code or deliver viruses. A web beacon is a small transparent .gif image that is embedded in an HTML page or email used to track when the page or email has been viewed. Most browsers are initially set to accept cookies, and most services that include similar devices are typically initially activated to collect data. You can set your browser to notify you when you receive a cookie, giving you the chance to decide whether or not to accept it. We do not support browsers’ Do Not Track features. You can enable or disable Do Not Track by visiting the preferences or settings page of your browser.
9. Protecting Your Information
We use a variety of security measures, including SSL, encryption, and authentication tools, to help protect your information. Passwords are stored only in hashed form. We do not retain your Personal Information for longer than is necessary for our business purposes. When we no longer need your Personal Information, we dispose of it safely.
10. Data Retention
Kenexx will retain your information only for as long as is necessary for the purposes set out in this policy, for as long as your account is active, or as needed to provide the Services to you. If you no longer want Kenexx to use your information to provide the Services to you, you may close your account. Kenexx will retain and use your information to the extent necessary to comply with our legal obligations (for example, if we are required to retain your information to comply with applicable tax or revenue laws), resolve disputes, and enforce our agreements. In addition, Kenexx Merchants may also be required to retain and use your information in order to comply with their legal obligations. Please note that closing your account may not free up your email address, username, or shop name (if any) for reuse on a new account. We also retain log files for internal analysis purposes. These log files are generally retained for a brief period of time, except in cases where they are used for site safety and security, to improve site functionality, or we are legally obligated to retain them for longer time periods.
11. Disclosure to Third Parties
We will not share your Personal Information with third parties without your express consent, except in the limited circumstances described below:
- We may share your Personal Information with third-party service providers for the limited purposes described in the section entitled “How Your Information Is Used.” Kenexx engages third-party companies and individuals (such as payment processors, hosting and email providers, research companies, and analytics and security providers) to help us operate and provide the Services. These third parties have only limited access to your information, may use your information only to perform these tasks on our behalf, and are obligated to Kenexx not to disclose or use your information for other purposes.
- We share with a Merchant the information needed to honor a Promotion and attribute a purchase: the referral code or link used, the value of the purchase, and the Referrer’s name as shown on the Services.
- We will share your Personal Information when required by law, regulation, or litigation, and as necessary for purposes of national security, law enforcement, or other issues of public importance.
- In some cases, Kenexx may choose to buy or sell assets. In these types of transactions (such as a sale, merger, liquidation, receivership, or transfer of all or substantially all of Kenexx’s assets), user information is typically one of the business assets that is transferred. If Kenexx intends to transfer information about you, Kenexx will notify you by email or by putting a prominent notice on the Site and the App, and you will be afforded an opportunity to opt out before information about you becomes subject to a different privacy policy.
Third-party plug-ins also may collect information about your use of the Site. For example, when you load a page on the Site that has a social plug-in from a third-party site or service, such as a “Like” or “Send” button, you are also loading content from that third-party site. That site may request cookies directly from your browser. These interactions are subject to the privacy policy of the third-party site. In addition, certain cookies and other tracking mechanisms on the Site are used by third parties for targeted online marketing and other purposes. These technologies allow a partner to recognize your computer or mobile device each time you use the Services, but do not allow access to Personal Information from Kenexx. Please be aware that when you use third-party sites or services, their own terms and privacy policies will govern your use of those sites or services.
12. Non-Member Information
Kenexx may receive or obtain information (for example, an email address, phone number, or IP address) about a person who is not yet a registered Kenexx user (a “non-member”) in connection with certain Kenexx features, such as when a non-member subscribes to a Kenexx newsletter, a member invites a non-member to visit the Site, or a member matches their contacts against Kenexx members. Non-member information is used only for the purposes disclosed when it was submitted to Kenexx or to facilitate action authorized by the non-member. A non-member can contact Kenexx support if they do not want Kenexx to retain their information.
13. Your Choices
- If at any time you are uncomfortable with our use of your Personal Information for internal marketing purposes and for the purpose of creating aggregate reports, you may opt out by email as described in “Opting Out or Updating Your Personal Information and Privacy Preferences.” Note that if you opt not to provide us with certain mandatory information, then our products and services may be unavailable to you.
- You may similarly opt out of receiving communications from us, although we may find it necessary to continue to communicate with you regarding your use of the Services.
- For our websites, you may set your browser to refuse all or some browser cookies, or to alert you when cookies are being sent. If you disable or refuse cookies, please note that some parts of this Site may then be inaccessible or not function properly.
- You can revoke any device permission (contacts, camera, photos, location, notifications) at any time in your device settings.
14. Governing Law
The terms of this Privacy Policy are governed by and in accordance with the laws of the State of California and, where applicable, the laws of the countries where our servers are located. You should not provide us with any Personal Information unless you consent to the application of United States law and, where applicable, California law, and to the use and disclosure of your information in accordance with the terms of this Privacy Policy. The Services are intended for users in the United States. Users outside the United States are advised not to disclose Personal Information to us.
15. Your California Privacy Rights
If you are a California resident, you have the right to request what Personal Information we have collected about you, to request that we delete it, to request that we correct it, and to not be discriminated against for exercising these rights. We do not sell your Personal Information in exchange for money. To make a request, contact us as described in the next section. We will verify your identity before acting on a request.
16. Opting Out or Updating Your Personal Information and Privacy Preferences
You have the right to access, correct and delete inaccuracies in your Personal Information and privacy preferences on the Services at any time by signing into your account and editing your Personal Information in your account profile. You may also do so by contacting us by telephone or email.
You may close your account and request deletion of your Personal Information from within the App or by emailing us. We will delete or anonymize your Personal Information except where we must keep it as described in “Data Retention.”
If at any time you wish to withdraw your consent to our processing of your data or opt out of our use of your information for internal marketing purposes or for compiling aggregate reports, you may do so by sending a written notice to admin@kenexx.com. Note that your withdrawal of consent may prevent us from providing the Services to you.
17. Privacy Complaints and Contact
We take our users’ privacy concerns seriously. If you believe that we have not complied with this Privacy Policy with respect to your Personal Information, you may write to us at admin@kenexx.com or call (833) 4-KENEXX (453-6399).
Also, please note that we are not responsible for the content or privacy practices of third-party websites or integrated products to which the Site or the Services may link. You should review the privacy policies of such sites before using the associated sites.
